About

Domestic Building Law Victoria is a blog commentary on the laws of Victoria, Australia concerning domestic building (primarily the Domestic Building Contracts Act 1995), and the Domestic Building List of the Victorian Civil and Administrative Tribunal. It is published by Scott Krischock, Barrister.  The blog focusses on legal issues, rather than on technical building matters.

Lawyers are the intended audience for the blog, and accordingly it is written assuming that readers have an understanding of general legal principles (particularly in relation to contract). While there are a number of legal texts concerning building and construction law, there is limited material available concerning the Domestic Building Contracts Act and decisions, primarily of VCAT, which interpret and apply it.

There are a number of ways to access the blog.  Clicking on “Posts” above will take you to the most recent posts.  The expandable listing of “Categories” on the right hand side of this page is equivalent to a table of contents, and the listing of “Tags” is equivalent to an index.  Clicking on a category or tag will bring up all related posts.  Finally, the text of posts can be searched using the search box at the top of each page.  My post giving an overview of the Domestic Building Contracts Act is a good starting point for readers who are not familiar with it.

Generally speaking the first time I refer to legislation or a particular section in a post I include a link to the relevant Austlii page.  Subsequent references will not have the link.  Where I refer to a case I include a link to the report published on Austlii, and I also try to include links in the text to related posts.

Please note that from time to time I amend posts.  As an amended post retains its original posting date, it will not necessarily appear in the listing of recent posts.
